Decision:

Members noted the update in relation to amended opening hours for the premises and agreed the opening hours of 9am - 11pm. A door supervisor will be employed during these opening hours and 31 conditions, suggested by the applicant, will be added to the premises licence.

Minutes:

3.1      The Chair welcomed those present to the meeting of the Licensing Committee. She then invited the Crime Enforcement and Regulation (CER) Manager to introduce the application.

3.2      The CER Manager said that at a hearing of the Licensing Committee on 3 November 2020, permission was granted for a gaming centre, under the Gambling Act 2005, for Palace Amusements 70 Deptford High Street SE8 4RT between the hours of 12 noon and 11pm. This was subject to 31 conditions proposed by the applicant being added to the premises licence as well as a door premises supervisor being employed during those opening hours.

 

3.3      The CER manager explained that on 16 November 2020, this decision was appealed by the applicant. Following negotiation between the legal services with instruction by the licensing team, a compromise was agreed. Negotiations took into account representations from objectors and the considerations upon which members made their decision. The compromise agreed was to amend the opening hours of the premises from 12 noon - 11pm to 9am – 11pm with the same conditions being included. The applicant withdrew his application and the need for a court hearing was negated. The CER officer recommended that members note this information and agree the amended hours of operation for the premises.

 

3.4      Councillor Howard asked the reason why the applicant believed the hours of business should be extended. The CER Manager said that the applicant was concerned that they would not be able to trade under the reduced hours because it would not be viable. They also considered that the 31 conditions added to the licence in addition to the requirement for a door supervisor would satisfy all the concerns of the Committee, particularly regarding young people being able to gain access to the premises.

 

            Members then withdrew into closed session to make their decision.

RESOLVED that under Section 100 (A) (4) of the Local Government Act1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 12 (A) of the Act, as amended by the Local Authorities (Executive Arrangements) (Access to Information) (Amendments) (England) Regulations 2006 and the public interest in maintaining the exemption outweighed the public interest in disclosing the information:
