RESOLVED that the minutes of the meeting of the Licensing Committee held on 16 October 2019be confirmed and signed.

None.

In the matter of the application for a new Premises Licence, the Committee considered the relevant representations made.

The Committee made the following determination:

With a view to ensuring the promotion of the licensing objectives, in accordance with the provisions of the statutory guidance and the principles of our licensing policy, the application for a new premises licence was GRANTED subject to the opening hours of the premises being as follows:

• Monday to Thursday – 10am -11.00 pm

• Friday and Saturday – 10am-midnight

• Sunday – 10am -10.00 pm

The following additional conditions were also agreed and will be added to the premises licence.

1.The premises shall install and maintain a comprehensive CCTV system. All entry and exit points will be covered enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record whilst the premises is open for licensable activities and during all times when customers remain on the premises. All recordings shall be stored for a minimum period of 31 days with date and time stamping. Recordings shall be made available upon the request of Police or authorized officer throughout the preceding 31-day period, such copies shall in any event be provided within forty-eight (48) hours.

2. A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises are open to the public. This staff member must be able to show a Local Authority or Police Officer recent data or footage when requested.

3. Notices shall be displayed advertising that CCTV is in operation.

4. A Challenge 25 proof of age scheme shall be operated at the premises where the only acceptable forms of identification are (recognized photographic identification cards, such as a driving license or passport / Holographical marked PASS scheme identification cards)

5. An incident log shall be kept at the premises, and made available on request to an authorized officer of the Council or the Police, which will record the following:

(a) All crimes reported to the venue

(b) All ejections of patrons

(c) Any incidents of disorder

(d) All seizures of drugs or offensive weapons

(e) Any faults in the CCTV.

(f) Any refusal of the sale of alcohol

(g) Any visit by a relevant authority or emergency service.

6. A register of security personnel employed on the premises shall be maintained in a legible format and made available to police upon reasonable request. The register should be completed by the DPS/ duty manager/ nominated staff member at the commencement of work by each member of security staff and details recorded should include; full name, SIA badge number, time of commencement of duties. The security operative should then sign their name. This only to be completed when using door supervisors.

3.1      The Chair welcomed all parties to the meeting and introductions were made. She then invited Ms Spall to introduce the application.

            Licensing Officer   

3.2      Ms Spall said that members were being asked to consider this application for a new premises licence for Arch 2 Deptford Railway Station SE8 4NS. She outlined the application for the licensable activities which had been made by Balcca Ltd. Four representations had been received from local residents. A representation was also received from the Deptford Society. The objections were based primarily on the grounds of the prevention of public nuisance

3.3      Ms Spall said that new conditions and a reduction in hours had been agreed with the applicant, the licensing authority and Police and she read them out. Following these new conditions, the Deptford Society had withdrawn their objection, the other four objections had not been withdrawn. She said that it was officers’ understanding that the applicants’ agreed to the new conditions and hours in a letter received from their solicitor on 23 October 2019. She asked for confirmation from the applicant that they still agreed to the new conditions and new licensed hours. Ms Spall then outlined the options available to members when making a decision. The applicants said that Thomas and Thomas (solicitors) were no longer acting on their behalf. They confirmed that they still agreed with the amended hours and conditions within the solicitor’s letter. The Chair read out the amended hours within this letter.

3.4      Arian Mucaj said that he wants to run a restaurant. It would not be a night club, and only background music would be played. The original application had been for a closing time of 2am but it was not expected that the restaurant would be open until this time on many occasions. The application had been made so they had the flexibility to close later if required. The business would mainly be to provide good fresh food in the restaurant.

3.5      Councillor Powell asked whether there would be a separate function room for parties.  Taulant Mucaj said that they had not planned for a function room, but is something that could be considered in the future. A small area could be cordoned off if patrons wanted to host a party in the restaurant. Mr Ari Mucaj said that a lot of money had been spent on the premises and he expected the frontage to be an asset to the local area.

3.6      Members were advised that the capacity of the restaurant is 60-65. They will not be employing an online food delivery company to distribute their food.

3.7      Mr Leslie said that was not objecting to the application but rather the common practise of local businesses applying for a premises licence until 2am.
